Welcome to Generous! These Terms of Use ("Terms") govern your access to and use of the website, products, and services offered by Generous, Inc. ("Generous," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

3. Orders and Transactions
Generous is a platform that connects customers with independent sellers. When you place an order, you are purchasing directly from the seller, who acts as the Seller of Record and is responsible for fulfillment, shipping, and customer service for the item(s).
We facilitate the transaction, including collecting payment on the seller’s behalf, but we are not the seller of the goods (unless explicitly stated).
4. Content and Intellectual Property
All content on the Generous platform—including text, images, logos, and software—is owned by or licensed to Generous and is protected by intellectual property laws.
You may not use, reproduce, or distribute our content without our express written permission, except as necessary for personal, non-commercial use of the site.
5. User-Generated Content
If you submit content (such as reviews, comments, or feedback), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with our services.
You are responsible for the legality and accuracy of any content you submit and must not upload anything that violates the rights of others or applicable laws.
6. Disclaimer of Warranties
Our services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Generous disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the services will be uninterrupted, secure, or error-free, or that the content is accurate or complete.
Third-Party Fulfillment and Redemption
Generous is a marketplace platform that connects users with participating merchants offering digital gift cards and other products. All gift cards are issued and fulfilled by the respective merchant or brand. Generous does not control, and is not responsible for, the availability, quality, validity, or redemption of any gift card after purchase.
Any issues regarding lost, expired, or unredeemable gift cards must be resolved directly with the issuing merchant. Generous is not liable for any failure by a merchant to honor a gift card, and disclaims all warranties to that effect.
7. Limitation of Liability
To the extent permitted by law, Generous and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the services.
Our total liability to you for any claim arising from the use of our services shall not exceed the greater of $100 or the amount you paid us in the 12 months prior to the claim.
8. Indemnification
You agree to indemnify and hold harmless Generous and its affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the services or your violation of these Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws rules. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
10. Modifications
We reserve the right to modify these Terms at any time. If changes are material, we will notify you through the platform or via email. Your continued use of the services after any changes indicates your acceptance of the updated Terms.
